This End User License Agreement ("EULA") is a legal agreement between you ("End User" or "you") and Pinstop Inc. ("Pinstop", "we", "us", or "our") for your access to and use of the Pinstop mobile application (the "App").
By downloading, installing, or using the App, you agree to be bound by the terms and conditions of this EULA. If you do not agree to all the terms of this EULA, you are not permitted to use the App.
The App allows you to create, upload, and share content, including photos and reviews (collectively, "User Content"). You retain all ownership rights to your User Content. However, by submitting User Content, you grant Pinstop a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and display your User Content in connection with the App and Pinstop's services.
You agree to use the App in a manner that is consistent with all applicable laws and regulations and in accordance with this EULA. You agree that you will not:
Pinstop reserves the right, but does not assume the obligation, to review, monitor, and remove any User Content that we, in our sole discretion, believe violates this EULA or is otherwise harmful or objectionable.
The App allows users to report User Content that they believe violates this EULA. Pinstop will review all reported content within a reasonable timeframe and take appropriate action, which may include removing the content and/or suspending or terminating the account of the user who posted the content.
The App is provided on an "as is" and "as available" basis. Pinstop disclaims all warranties, express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Pinstop does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
Pinstop shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the App.
Pinstop may terminate your access to the App for any reason, at any time, without notice. You may also terminate your access to the App by deleting it from your device.
This EULA shall be governed by and construed in accordance with the laws of the State of [Insert Your State], without regard to its conflict of law provisions.
This EULA constitutes the entire agreement between you and Pinstop regarding your use of the App and supersedes all prior or contemporaneous communications and proposals, whether oral or written.
If any provision of this EULA is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
